Dean Wilson have recently acted on behalf of a motorcyclist who was involved in a road traffic accident where liability remained unclear. The client sustained significant injuries to his leg and required a muscle graft from his shoulder and a skin graft from his left thigh. He had very little memory of the accident and the defendant denied liability on the basis the client was speeding which had yet to be proven. It became apparent the police report was imperative in proving either case but due to a backlog with the police, this could not be obtained for many months.
The client was left unable to work and so it was important rehabilitation was organised as soon as possible to avoid accumulating debt. Ben Davey was instructed by the client and despite liability being in dispute, was able to get the defendant agreed to jointly instruct a rehabilitation case manager and Ben subsequently obtained an early interim payment to assist with the client’s loss of earnings.
Dependant on what the police report contained, the client was at risk of being found contributory negligent to the accident and receiving up to a 50% reduction on his settlement. Despite this, Ben successfully obtained a substantial five-figure sum for the client without liability being determined and no contributory negligence deduction being made.
