Settlement obtained for brain injury sustained in road traffic accident, liability not admitted

Lyubov Nikolchova recently represented a client who sustained mild brain injury and wrist fractures in a road traffic accident. Despite liability not being admitted, Lyubov obtained multiple interim payments and eventually a successful settlement for our client. 

The accident 

Our client was the front seat passenger in her partner’s car when a drunk driver drove into the wrong side of the road and collided with them. Our client was taken to the hospital for treatment as she sustained bilateral wrist fractures, hand injuries, and a mild brain injury. 

The process 

The Defendant’s representatives refused to accept liability throughout the whole claim, despite being provided with supportive police evidence. The police had previously been notified that the Defendant was intending to drive while intoxicated and were on their way to intercept as the crash occurred. Another point of contention was the nature of our client’s injuries. The Defendant’s representatives denied that our client sustained a brain injury but also didn’t obtain their own neurology expert evidence to comment on this point. Our client also chose to complete a university course as she was unable to work but wanted to continue her professional development. Causation on our client’s time off work was also heavily in dispute. 

Despite these difficulties, Lyubov obtained multiple interim payments for our client to allow her to fund rehabilitation and assist her with the financial strains of being off work due to her injuries. 

The Defendant’s representatives made an offer to settle our client’s claim in early 2025. Our client made a counteroffer as she was eager to bring the case to an end, even though the expert evidence hadn’t been finalised. The Defendant’s representatives made further offers, the final one of which our client was happy to accept. This has allowed her to move on and focus on her studies, recovery, and treatment.
