Mr A was struck by a car whilst crossing the road in Hove, and suffered life changing orthopaedic injuries. It was alleged that the driver had not been keeping proper attention, and was therefore at fault for the collision. The driver was charged with careless driving, but later acquitted at trial.
Despite the acquittal, Ben Davey of Dean Wilson Solicitors continued with the claim, and alleged that the driver was driving too fast, and not keeping a proper lookout. Ben was able to obtain evidence of this and establish that if the driver had applied light braking, then Mr A would have safely made it across the road in time.
This led to the Defendant insurer agreeing that they would be prepared to discuss settlement in due course. In the meantime, they released substantial interim payments to cover Mr A’s loss of earnings, and pay for his rehabilitation in the community.
Following this, expert evidence was obtained in nine specialisms in order to establish what Mr A’s future needs would be as a result of his injuries. The parties met for settlement discussions, and a settlement was agreed that on a full capitalised basis was the equivalent of £1.81 million.
The settlement allows Mr A to move to single level accommodation, purchase specialist equipment such as an adapted vehicle and wheelchair, and pay for the care and support he will need as he ages.
