Ben Davey at Dean Wilson recently reached a quarter-of-a-million pound settlement for a Claimant in an employer’s liability case, after he suffered a major fracture to his leg as a result of an accident at work.
On 17 January 2022, Mr C was working at a site completing landscaping work. Whilst working several unstable pallets which had been stacked fell on Mr C, crushing his leg. He suffered a major fracture and multi-ligamental injury requiring surgical repair. He was initially informed by doctors that there was a 30% chance that he would lose his leg. As a result of his injuries, Mr C was left permanently disabled and unable to return to work. Mr C was advised he could never return to playing football or sports.
Our personal injury lawyers met with Mr C whilst he was in hospital and helped him obtain the funding to undergo the necessary rehabilitation treatment vital to his recovery. Dean Wilson held Mr C’s previous employer accountable for the accident in that they had failed to put in place the necessary equipment required to stabilise the pallets causing Mr C’s injury, and that whilst it was a known risk that the pallets were unstable, insufficient steps had been taken to mitigate this risk and protect the staff working on their site. Mr C’s employer admitted breach of their statutory duty to Mr C as their employee.
Ben Davey, assisted by Tom Gardiner, successfully obtained a £249,000 settlement for Mr C, claiming for Mr C’s future loss of earnings until retirement as a result of his injuries, as well as the cost of required future medical treatment on a private basis.
