Settlement Reached for Passenger Injured in Road Traffic Accident

Lyubov Nikolchova and Alex Brown recently obtained settlement for a client who was injured in a road traffic accident and later developed Graves’ disease. 

The Accident

In 2022 our client was a passenger in her daughter’s car when the incident occurred. Another vehicle failed to stop at a junction and drove directly into the passenger side of our client’s car, causing a collision. Our client sustained wrist fracture, soft tissue injury to her hip, and 2 months later developed Graves' disease. The main point of contention was whether our client’s Graves’ disease can be said to have been caused by the accident. 

Medical Evidence and Claim

Our team secured expert medical evidence that confirmed the development of Graves' disease was more likely than not caused by the traumatic stress of the accident. This information was vital in ensuring that our client’s injuries, both physical and psychological, were fully recognized and compensated for. This allowed the team to advance a claim for the future monitoring and treatment that our client required to manage her condition. Further, there was a possibility for our client to need wrist surgery in the future, the cost of which was included in her claim. The ongoing health concerns added an extra layer of complexity to the case, but with our client’s best interests in mind, we worked tirelessly to ensure she would be adequately supported in the future.

Legal Action and Settlement

To ensure our client’s right to compensation was protected, we issued court proceedings. An offer of £45,000 was received from the Defendant’s solicitors shortly after.

We consulted with counsel, who provided valuable advice, confirming that the offer was both reasonable and fair. Our client, after careful consideration, was happy to accept the offer, bringing the matter to a successful conclusion.

This settlement allows our client to move forward with her recovery, knowing that she is financially supported in managing the ongoing effects of her injuries.
