Dean Wilson Solicitors have recently settled two claims for a pedestrian who was injured, and for her husband who was a witness of the accident.
At the time of the accident, the Claimant and her husband were walking along the pavement. Whilst the Claimant was proceeding safely, the Defendant, who had turned onto the road on the opposite side, failed to correct their direction of travel and continued across the road into opposing traffic. The Defendant’s vehicle narrowly missed the other vehicles, before mounting the raised pavement, hitting a pedestrian, and continuing along the pavement towards the Claimant. The Defendant’s vehicle impacted the Claimant who suffered complex pelvic fractures and was trapped by the car. The Claimant’s husband, who managed to evade the collision, was a witness to the event and helped the Claimant to escape from under the vehicle but himself suffered psychological injures believing his wife might have been killed and suffered serious harm.
The Defendant's insurer refused to accept liability and indemnify the Defendant on the grounds that they had suffered a medical emergency. On this same logic, they initially refused to fund the Claimant’s private surgery, which was required due to extensive wait times on the NHS. Despite the Defendant’s position, Dean Wilson successfully fought for and secured multiple interim payments throughout the claim to fund the Claimant’s surgery and rehabilitation.
Ben Davey, assisted by Tom Saady Gardiner, of Dean Wilson Solicitors put pressure on the Defendant insurer to fund the Claimant’s surgery and private rehabilitation, and successfully settled the case in favour of the Claimant despite the Defendant insurer refusing liability. Dean Wilson Solicitors also settled a Secondary Victim claim for the Claimant’s husband for psychiatric injury as a result of witnessing the accident.
