Dean Wilson settle multi-million-pound claim following Road Traffic Accident resulting in complex orthopaedic injuries.

Dean Wilson have settled a long running personal injury claim for just under £5m for a Claimant after a serious road traffic accident. 

Background

Alex Brown was instructed by C following a head on collision in a Road Traffic Accident back in 2019. 

In the accident, C suffered catastrophic orthopaedic injuries to all 4 limbs but particularly their legs which were initially at serious risk of amputation. Thankfully, through excellent early treatment meant their legs were saved but she was left with significant limitations in her ability to walk and manage independently with day-to-day living. 

The Process

C had initially instructed alternate solicitors but contacted Alex as they felt their injuries were not being fully understood and instructed him to take over as their solicitor in early 2020. 

Alex assisted in switching C’s rehabilitation regime from a joint instruction with the defendant insurer to a single instruction to give C more control over their own care and rehabilitation regime and was able to obtain significant interim payments throughout the claim to fund their ongoing needs. 

The main arguments in the case revolved around whether C was able to manage without care on a day-to-day basis if they had a suitably adapted property that facilitated their needs. 

C was adamant that although predominantly a wheelchair user they wanted the freedom to go out and walk on their crutches and not be always bound to a wheelchair and to achieve this required ongoing care. The other key piece of evidence was demonstrating that C could not stand up from the floor if they had a fall, again signifying an ongoing need for support. 

The Result

The matter was to a joint settlement meeting in March 2024 and following a long day of negotiation, a settlement was achieved on behalf of C for just under £5,000,000 and included a significant sum of their ongoing care needs and future accommodation needs and providing security for C for the rest of their life.
