Dean Wilson Solicitors secure landmark 812% compensation increase at tribunal

Dean Wilson Solicitors have secured a landmark increase on behalf of a client after advising that he take his case to tribunal in appeal of a criminal injuries offer.

The Story

Mr H was assaulted in 2016. He was knocked to the ground and repeatedly hit over the head with a bottle, suffering brain damage, and severe psychological injury as a result. He suffered from daily seizures, memory problems, paranoia, and change in personality which all led to him having to give up his job as a personal trainer.

With the assistance of his mother, Mr H made a claim for damages to the Criminal Injuries Compensation Authority (CICA), a scheme set up to provide compensation to non fault victims of violent crime. CICA made Mr H an offer of settlement, but failed to take into account the severity of his injuries. Mr H consulted with Ben Davey of this firm, and after being advised to do so, instructed us to appeal the decision to the First Tier Tribunal. Ben pushed the tribunal to commission expert medical evidence which revealed the extent of Mr H’s injuries, and the decision to appeal was vindicated when the award was increased by 812% by the tribunal. The award will be managed on Mr H’s behalf and will provide him with security for the rest of his life.
