Common issues that arise out of negligence during pregnancy or birth causing cerebral palsy can include:

How long do I have to make a cerebral palsy claim?
Injuries to children mean that a claim must be started in the court within three years from their 18th birthday when they are deemed to be an adult. This means a claim must have been started in the court by the child’s 21st Birthday. Limitation will usually not apply for children where there is a severe brain injury which limits their ability to understand the legal proceedings and provide instructions to solicitors.
If a parent has a cerebral palsy claim also because of the negligent birth, their claim must be started within 3 years of the negligence occurring.

- Becca assisted Alex Brown to secure a six-figure sum for a client who suffered a severe leg injury in a road traffic accident. On taking the case over from another firm of solicitors, it became clear there were evidential issues, including urgent and complex disclosure, which were swiftly dealt with to enable the claim to progress to a successful resolution.
- Becca supported Alex who acted for an amputee injured in a motorcycle accident. Compensation of approximately £2,000,000 was achieved.

- Tom recently closely assisted in securing a successful seven-figure settlement for a Claimant who had suffered life-changing and permanent injuries arising out of a road traffic accident. Part of the claim included obtaining the cost of single-level accommodation and future care until the Claimant’s end of life.
- He has also assisted in several and various five and six-figure settlement sums for injuries arising out of road traffic accidents, clinical negligence cases, accidents at work, and secondary victim claims for psychiatric injury.
- Tom assists Ben Davey with pro bono work assisting families of the deceased to obtain legal representation at inquests, primarily for cases arising out of the failure of mental health services.

Katiee Griffiths
