Brain and spinal cord injury claim settled for £5.6 million

Ben Davey has recently settled a claim for £5.6 million on behalf of a 22 year old young man, who suffered very serious injuries in a road traffic accident when he was 17 years old.

What Happened

Mr E, who was 17 years of age at the time, was cycling home with a friend near their home in West Sussex. They were riding on a cycle path, which was separated from the road by a drop kerb.


Without warning a driver mounted the kerb, colliding with Mr E, and narrowly missing his friend. Due to the severity of the injuries suffered, Mr E’s friend initially thought that he was dead. Paramedics were called, and Mr E was stabilised and taken to hospital by air ambulance.


The driver was later convicted of causing serious injury by dangerous driving, and of driving under the influence of drugs and alcohol.
Once Mr E arrived at hospital the full extent of his injuries became clear. He had suffered a severe brain injury, damage to his spinal cord, as well as serious fractures to all four limbs.

What We Did

Mr E via his mother got in touch with our firm, and Ben Davey took immediate action. He was able to appoint a specialist rehabilitation case manager, and obtained funding from the Defendant driver’s insurance company to fund the same. Mr E was able to undergo specialist brain and spinal rehabilitation at Stoke Mandeville Hospital, before looking to return home to live with his father approximately 5 months after his accident.


At this point the specialist funding that Ben had obtained really proved it’s benefits. Mr E had a support work funded by the insurer, as well as a team comprising of a neuropsychologist, an occupational therapist, and a neuro-physiotherapist.  With their help he was able to return to college.
In due time funding was also obtained for a specialist ankle foot orthosis, and other equipment to help Mr E maximise his walking distance.


Around 3 years after his accident, funding was obtained in order to allow Mr E to move into his own home with a support package. The purpose of this was to see what kind of long-term support Mr E might need going forward. The independent living trial was a success, and it allowed the claim to be settled for £5.6million in October 2024.


The settlement will allow Mr E to purchase and adapt his own home, as well as fund the support package he requires to lead as normal a life as possible.
