The most obvious legal avenue following an assault is to report the matter to the police. Sexual assault is a criminal offence.

It may also be possible to pursue a civil claim for damages following a sexual assault. Any claim would be pursued against the perpetrator of the assault and/or an employer, if the assault took place at work. Damages would be likely to include sums for the assault itself, for any psychological injury caused, and other expenses and losses including, where appropriate loss of earnings and cost of treatment. 

We recognise that the decision to pursue a claim is not necessarily easy and we will consider carefully with you whether or not it is likely to be viable. This is not always the case where the perpetrator is unlikely to have sufficient funds to pay damages. Should a claim progress, our team are experienced at working with our clients as sensitively as possible recognising how difficult revisiting a such traumatic experience during the process of gathering evidence can be.

Where a civil claim against the perpetrator is not possible and the assault has been reported to the police, it may be possible instead to claim compensation from the Criminal Injuries Compensation Authority - a government funded body that compensates the victims of violent crime.
