Background to the Case

Mr A, a self-employed carpenter, was engaged by the Defendant to build a pitch roof on a garage conversion. Within an hour of arriving on site Mr A fell from height after scaffolding which the Defendant had erected collapsed.

Mr A fell approximately three metres to the floor landing on his side and striking his head on a plant pot. Mr A sustained a fracture to his pelvis, a complex fracture of his wrist, as well as a laceration/fracture to his eye/eye socket. He was unable to weight bear for almost two months and was unable to work for over five months. The wrist injury required initial surgery with follow up procedures and an increased chance that it would affect his ability to work in the future.

The Accident Compensation Obtained

Alex Brown and Ben Davey were able to obtain reports from three independent experts who set out what the prognosis for Mr A would be later in life and to what extent his injuries where likely to affect him. Despite the Defendant’s insurer failing to admit liability (or even confirm that they would provide insurance cover to the Defendant for the claim!), Ben and Alex were able to settle the claim. The damages received compensated Mr A for his loss of earnings, pain and suffering, as well as allowing him to undergo future treatment required.
