Update on No Fault Divorce

Overview of the current divorce law in England and Wales

No-Fault Divorce will now come into force on 6 April 2022. Although the delay from Autumn 2021 is disappointing, the announcement paves the way for an end to the “blame game”, making it easier for separating couples to focus on how they will divide their property and assets and most importantly the care of any children, instead of having to produce evidence of bad behaviour to initiate divorce proceedings.

It is understood that applications will be able to be made either jointly or as an individual and that the process will be more streamlined than the current one, with Decree Nisi being pronounced more quickly.
