Six figure settlement for car accident caused by driver’s loss of consciousness

Lyubov Nikolchova obtained a favourable settlement for three passengers who were injured in a car accident, when the driver lost consciousness at the wheel. One of them had approached another firm of solicitors prior who had advised her she didn’t have a personal injury claim. 

The accident

Four people in their seventies and eighties were on their way to a social event in early 2024 when the driver suddenly lost consciousness. The front seat passenger tried to steer the car away from traffic but the driver re-gained consciousness and took control of the wheel, leading to the car being veered to the side of the road into a ditch and landing on its side. 

One passenger sustained a spinal bilateral subluxation and end plate fracture, necessitating cervical discectomy, fusion, and fixation. Another sustained a fractured wrist, fractured sternum, blood clot in the lungs, and had ongoing breathlessness. The third suffered ten fractured ribs and a fractured sternum with ongoing shortness of breath and fatigue.

The process

One of the passengers had approached another law firm who refused to accept instructions, claiming that the Defendant would have a defence of automatism (a legal defence that the Defendant involuntary performed an action without making the conscious decision to act). Lyubov advised the client that she saw prospects in the case and agreed to investigate further. Soon after, she accepted instructions from the other two passengers.  

A Letter of Notification was sent to the Defendant’s insurers, arguing that liability should be admitted for the accident. Early rehabilitation was offered to all three clients, two of whom benefited from MSK physiotherapy, respiratory physiotherapy and specialist consultations. 
Liability was then admitted in full and early settlement offers were received in all three cases, totalling a six-figure settlement. The clients felt that they had made good recovery accepted the offers, bringing their cases to a conclusion a mere 3 months after Dean Wilson were instructed.
