Settlement Secured for Cyclist Injured in Car Dooring Case

Lyubov Nikolchova recently successfully settled a personal injury claim for a cyclist who suffered orthopaedic and psychological injuries following a road traffic collision involving a vehicle opening their door in their path.

The Incident

The claim arose from an incident in 2022, when our client was cycling with his partner. As he passed a stationary vehicle, the front seat passenger opened the car door directly into his path, causing a collision which threw him from his bicycle.

We argued that the vehicle had pulled over without indicating and stopped in unsafe position near a school entrance, posing a hazard. Liability was heavily disputed throughout the claim, with the Defendant denying there was any collision between the parties.

Challenges in the Case

The case was complicated by a number of factors.

One of the principal challenges in the case was that the occupants of the vehicle left the scene without providing their details. This meant that before liability could even be investigated, extensive efforts were required to identify the responsible parties and secure the evidence necessary to pursue the claim.

In addition, liability remained in dispute throughout, with the Defendant alleging our client had tripped over another road hazard and/or that he was responsible for the accident by his own negligence.

The Injuries

As a result of the collision, our client sustained a shoulder fracture, rib fractures and underwent the necessary treatment. Our client also developed psychological symptoms consistent with an adjustment disorder, including anxiety and low mood, which were exacerbated by the manner in which the incident unfolded.

Settlement

Despite the obstacles, we were able to progress the matter and ultimately secure a favourable settlement for our client.

Following negotiations, the Defendant’s made an offer that was 60% higher than their original offer, which our client accepted on our advice.

Conclusion

This case highlights the serious consequences that can arise from failing to check before opening a vehicle door, particularly in busy urban areas with cyclists present.
