Settlement of over £600,000 for Client with severe ankle injury following RTA Accident

Alex Brown has been able to secure substantial settlement for a Claimant who was involved in a head on collision with a driver who was on the wrong side of the road.

The Case

The accident occurred when the Claimant was driving home from work. The Defendant travelling in the opposite direction suddenly and without warning pulled into the opposite lane and collided head on with the Claimant who was trapped in his vehicle unable to move his leg.

The Claimant was rushed dot hospital where thankfully, after initial concerns about a possible amputation, they were able to save the Claimant’s foot but a long recovery was anticipated.

The Claim

Alex was able to assist the Claimant is accessing rehabilitation funding almost immediately following his accident thanks to early intervention via the Major Trauma Signposting Partnership and early notification of the claim to the Defendant Insurer.

The early access to rehabilitation funding on a collaborative basis was key as the Defendant Insurer wanted to make liability investigations which took almost 2 years to complete due to injuries to the Defendant and questions around whether they had reported a pre-existing medical condition which may have been the cause of the accident.

In addition to joint rehabilitation funding which included a case manager, physiotherapist and psychology, interim payments were also obtained to help the Claimant adapt his home to assist with him becoming a partial wheelchair user during his recovery.

The Claimant’s recovery was hindered by the ankle bones failing to unionise which were causing the Claimant considerable ongoing pain and the ongoing (small) risk of amputation in the future.

The Outcome

The parties viewed the valuation of the case very differently particularly in respect of future losses around accommodation and future care.

The Parties were however able to make progress in settlement discussions, and the claim was settled for over £600,000.
