Settlement obtained for a widower after road traffic accident

Lyubov Nikolchova and Alex Brown recently obtained a favourable settlement for a our client whose wife sadly passed away in a car accident. Our client’s compensation included recovery of funeral costs, loss of benefits, loss of pension as well as an award for the pain and suffering suffered by his wife between the accident and her unfortunate death shortly after. He also received a bereavement award as the spouse of the deceased.

Background 

In early 2023 our client was driving their car when the Defendant went through a junction without giving the proper right of way, causing a collision. The emergency services were called but, unfortunately, our client’s wife passed away from her injuries shortly after the accident occurred.
The Defendant’s insurers refused to accept liability for over a year as they relied on the criminal process not being finalised. Nevertheless, Lyubov and Alex were confident in the case and proceeded with the relevant quantum investigations to ensure a timely conclusion of the claim. The eventual liability admission coincided with our initiation of settlement discussions. 

Evaluation process 

At the time of the accident, our client’s wife was in her late 70s and suffered from Multiple sclerosis, meaning she was in receipt of state-funded care and a Motability vehicle.

The team obtained counsel’s advice on the recoverability of the loss of benefits, which were paid to our client’s wife but were used for family outgoings. Expert evidence confirmed that the deceased’s life was cut short by a year, meaning that the team were also to submit a Schedule of Loss covering the financial loss experienced by our client within that time. 

Settlement discussions commenced in March 2025 with multiple offers from both sides. Eventually, the Defendant made a reasonable offer, constituting 130% of their opening position and the matter concluded in July 2025.
