Lyubov Nikolchova and Becca Porter recently obtained favourable settlement for a driver and passenger involved in a car accident.
In early 2023, our clients were driving along an established road when a motorcycle crashed into the back of their car. The car’s braking system also had activated at the same time. The accident was reported to the police, who regrettably didn’t conduct any investigations.
The motorcyclist’s insurers accepted liability early on and offered funding for rehabilitation. At the time, both clients had the benefit of private healthcare cover and were under the care of specialists, so they felt their injuries were managed appropriately. During the case, Lyubov had regular meetings with the insurers to discuss the clients’ injuries and treatment needs, which ensured progress was made in both claims.
The team proceed to obtain expert medical evidence to investigate the full extent of the injuries each client suffered. One of our clients had had an accident the year before and the other underwent heart surgery during the case. The full medical history of both clients was carefully studied to ensure the impact of the accident can be accurately accounted for. The independent experts instructed opined that both clients had pre-existing spinal conditions which were exacerbated by the accident. Therefore, we submitted a claim for the impact the exacerbation had had on their work abilities, their loss of earnings, as well as the private treatment costs incurred.
Most notably, in early 2025 the insurers made allegations that the emergency braking and motorcyclist hit were two separate accidents and, therefore, at least some liability should be borne by our clients’ car manufacturer. Lyubov worked with our clients to review the records held by the car manufacturer and their own investigations of the braking system, which had concluded that the car didn’t malfunction.
The insurers maintained these allegations for some time, however, settlement negotiations for both cases commenced in mid-2025 with the cases eventually being brought to conclusion in July 2025.
