Serious Road Traffic Accident Claim Settled

Ben Davey and Jessica Edwards recently secured a successful outcome in a complex road traffic accident claim, representing a client who suffered serious injuries as a passenger in a car accident. 

The Incident

In September 2023, our client was driven by the Defendant to collect a Chinese takeaway. While driving on country roads, the Defendant lost control of the vehicle. According to police reports, the car struck a curb, veered onto a grass verge, and astonishingly landed on the roof of a barn before crashing back down.

Emergency services—including police, ambulance, and fire brigade—were dispatched to the scene. Due to the severity of the crash, the fire brigade had to remove the car’s roof to extract both occupants, who suffered catastrophic injuries. Our client was taken to Royal Sussex County Hospital in Brighton for urgent care. Our client suffered multiple orthopaedic injuries along with a traumatic brain injury (TBI)

Legal Action

Within 2 months of being instructed by our client, and prior to an admission of liability from the Defendant, we secured an interim payment to ensure financial stability for our client and her family during the early stages of recovery.

In addition, recognising the complexity of her injuries and the psychological trauma involved, we secured funding for a comprehensive private rehabilitation programme. This included multi-disciplinary support tailored to her physical and emotional needs, with a focus on helping her resume family roles at home and reintegrate into daily life.

In many serious trauma cases, secondary injuries can be overlooked during initial treatment, especially when the focus is on life-threatening or visibly severe injuries. Following discharge from hospital, patients often require extended bed rest and are unable to resume their normal routines for some time. 

Our client began experiencing intense pain in her knee and shoulder after discharge from hospital. These symptoms were not initially detected, and no further scans were scheduled through the NHS. To avoid delays and reduce pressure on public services our client underwent private scans and consultations, funded by the Defendant. This allowed for a prompt diagnosis and timely treatment, accelerating her overall recovery timeline.

Settlement and Support

The claim was ultimately resolved with a six-figure settlement, reflecting the seriousness of the incident and the long-term impact on our client’s wellbeing. This outcome not only provided financial security but also ensured continued access to rehabilitation services and support systems.

Throughout the claim, our priority was to ensure our client received not only financial compensation but also the tools and support necessary to rebuild her life.
