£400k settlement for client who suffered brain injury as a result of a road traffic accident

Dean Wilson Solicitors have obtained a substantial settlement of £400,000 for a client who suffered a brain injury as a result of a road traffic accident. 

What happened?

Mr N was crossing a road close to his home whilst walking into Brighton town centre when the Defendant, a taxi driver, suddenly accelerated into Mr N and a female pedestrian who was crossing the road at the same time.

As a result of the accident, Mr N suffered a severe brain injury and a knee fracture with ligament damage. He was rushed to the Royal Sussex County Hospital, where he stayed for a month. As a result of the accident, Mr N suffered from memory and speech difficulties, as well as fatigue and dizziness. He required mobility aids for approximately 6 months after the accident.

Ben Davey, Partner at Dean Wilson LLP, was instructed in this matter on a no-win no-fee agreement. He visited Mr N and his partner at their home in the week after Mr N was discharged from the hospital.

How Dean Wilson helped

After being instructed, Ben Davey organised a private rehabilitation case manager from the Proclaim Care Group to visit Mr N and prepare a report on his treatment needs and negotiated for the Defendant insurer to fund Mr N’s rehabilitation whilst the claim was ongoing.

In addition to obtaining funding towards Mr N’s treatment, Dean Wilson Solicitors also obtained an admission of primary liability from the Defendant and secured £45,000 of early (interim) payments to compensate Mr N for his ongoing loss of earnings during the lifetime of the claim.

To support Mr N’s claim, Dean Wilson LLP obtained extensive supportive evidence from independent orthopaedic, neurology, neuropsychology, and neuropsychiatry medical experts. 

Settlement

The claim settled favourably in November 2025 for a settlement of £400,000, which included compensation for Mr N’s loss of earnings until retirement. Ben Davey conducted this matter and was assisted by Shahram Sharghy, Barrister, of 1 Crown Office Row, and Tom Saady Gardiner, Senior Paralegal.
