Dean Wilson ‘Save’ Case And Achieve Multi-Million Pound Settlement for Claimant

An overview of Dean Wilson's legal representation in a multi-million pound settlement case

Dean Wilson Solicitors have settled a severe brain injury case on behalf of a Claimant. The multi-million pound settlement was approved by High Court Master Dagnall on 9 April 2020 with him acknowledging that the settlement represented an excellent outcome. Master Dagnall also granted an anonymity application to protect the Claimant’s identity as he is a vulnerable patient of the Court of Protection. Dean Wilson were the third and final solicitors to act for the Claimant after his litigation friend felt that two national firms previously instructed, had poorly progressed the case on his behalf.

The Claimant suffered his life changing injuries when he was knocked from his motorbike in 2016. He was unable to return to any form of employment and required a comprehensive rehabilitation package, including 24 hour care.

The Claimant’s litigation friend instructed Dean Wilson Solicitors in April 2019 after his previous solicitors had just lost an interim payment application in the High Court. The defeat in the application led to the Claimant being left in debt, and his full care package being withdrawn.

In just 10 months we were able to turn the evidence around and the Defendant agreed to meet the Claimant and his legal team for a settlement meeting in February 2020. A few days prior to the meeting they set out their view that the claim was only worth £40,000. Despite this they were persuaded to settle the claim for a multi-million pound sum. The damages will now be managed by our specialist Court of Protection team, to protect the Claimant for the rest of his life.
