Should mediation be compulsory?

Before you can lodge any Financial or Children Act application at the court, you will be required to attend a MIAM (Mediation Information and Assessment Meeting), to assess whether your situation is suitable for mediation.

Of course, there are circumstances in which mediation is unsuitable, for example where there are allegations of domestic abuse or where there is a significant power imbalance between the parties. In the case of domestic violence, you are automatically exempt from attending an MIAM.
