Brain Injury claim settled against Royal Mail Group Limited

On 2 March 2022 Mrs Justice Hill approved a settlement reached on behalf of “EEE” in a claim bought against Royal Mail Group Limited.

Dean Wilson LLP’s client “EEE” brought a claim via his litigation friend “FFF” after he was involved in a serious road traffic accident in December 2018. The Claimant suffered multiple orthopaedic injuries which were not disputed. He also suffered a brain injury which the Claimant alleged was a serious one. The Defendant disputed that a brain injury had been suffered, saying that any injury suffered was mild.

The severity of any head injury suffered became a significant point in the claim because two years after the accident the Claimant was diagnosed with advanced Alzheimer disease necessitating 24 hour care in a nursing home facility. Recognising this need, and not withstanding the fact that they denied that they had a responsibility to do so, Royal Mail Group Limited provided support to enable the Claimant to maximise his statutory funding entitlement.

The experts were unable to agree whether the accident had caused the Claimant’s dementia to become worse. The Claimant’s experts said that the accident had accelerated the Claimant’s symptoms by around five years, whilst the Defendant’s experts said that it had little or no impact.

A settlement was reached in January 2022 and approved by the High Court on 2 March 2022. The settlement provides the Claimant with financial security for the rest of his life.
